CDL driver with a 0.13 breath result
CDL Driver from Bartlett, ILIt started like a lot of DUI arrests in Illinois these days - with an anonymous call to the police. It ended with an arrest and a 0.13 breath test. Our client works in a job that requires a Commercial Driver's License (CDL) and the ability to drive throughout Illinois. A young man just building a family, he could not afford the one year CDL cancellation that would come as a result of the automatic suspension as a result of the arrest, or a finding of guilty on the DUI. Simply put, he'd be out of a job.
When all was said and done, his suspension was rescinded, and all charges in the case dismissed. After a pre-trial hearing, the Judge ruled that the officer's decision to stop our client was illegal, and therefore the arrest could not stand.
